This role will lead the implementation of the Data Privacy program in EMEA and APAC regions in accordance with Baxter Global Privacy Policy and GDPR policy as well as other local laws supporting the implementation of the privacy program in the regions. The role will partner with senior functional leaders in order to mobilize resources across the organization to implement the Data Privacy program so that Baxter employees can achieve their business goals consistent with Baxter’s values and standards and applicable legal requirements. The successful candidate will be appointed as the DPO for Baxter entities before EU Data Protection Authorities or other authorities in the regions as per local requirements.
ROLE AND RESPONSIBILITIES
- Act as the deputy of the Chief Privacy Officer in EMEA and APAC and implement the Global Privacy Office program being the first point of contact for the functions in those regions;
- Drive Baxter’s privacy and cyber compliance efforts and milestones while building a culture of privacy;
- Be a member of the Baxter Privacy Office LT, attend the Privacy Office meetings, execute projects assigned by the CPO and manage the privacy team in the regions;
- Act as the subject matter expert for privacy related matters in the Baxter Global LT;
- Manage and coordinate the group of the Local Privacy Champions according to the governance model implemented by the Baxter Privacy Office, including organizing monthly meetings, attending their report out to country leadership and monitor their support to the local organizations;
- Act as the first point of contact for the EMEA and APAC Presidents and regional LTs, on privacy matters and report out quarterly on the status of the region on privacy matters to the regional president;
- Be able to act independently and provide advice and counsel to Baxter on privacy and cyber response matters;
- Provide leadership through leveraging of business and industry information to enable the business or region in identifying and solving business issues;
- Partner and interact closely with country leaders and/or teams in the identification of privacy related issues and support the LPCs and the EMEA/APAC privacy teams in the efficient resolution;
- Identify areas of vulnerability and risk and undertake corrective plans to resolve the issues;
- Create awareness and training as needed following the Privacy Office Curriculum and functional needs;
- Conduct or support internal investigations of allegations of data incidents;
- Manage in collaboration with legal data subject requests as per privacy laws;
- Conduct privacy impact assessments, privacy by design assessments, cross border transfer assessments or similar evaluations;
- Organize any local translation of global templates that will be available for the whole organization and if need be local clearance by the local lawyers.
- Maintain up to date privacy expertise, skills, and competency regarding evolving laws, regulations, guidance and directives impacting Baxter internationally.
POSITION REQUIREMENTS
- Substantial legal and privacy experience. Law Degree from an EU jurisdiction and bar membership required. The ideal candidate will have a minimum of 10 years of relevant experience gained from a mix of law firm private practice and in-house positions, At least 5 years in-house experience working in Privacy or leading role in privacy practice in a Law Firm;
- Healthcare experience required. Medical Device and international experience strongly preferred.
- Expert knowledge of global data privacy and security requirements including GDPR.
- Experience in managing data incidents and breaches.
- Proven experience with counseling business clients.
- Experience in addressing multinational legal issues.
- Ability to work independently and navigate ambiguous legal issues.
- Fluency in English.
- Position profile: Associate General Counsel, Global Privacy/Cyber – primarily responsible for EMEA, EU DPO, APAC
- Proven track record in working with others in addressing privacy issues within complex organization environment.
- Proactive business minded leader with a history of identifying and solving business issues in addition to providing practical legal advice.
- High degree of accountability, professional motivation and drive with the resulting ability to thrive in a results-oriented culture while driving excellence to optimize the execution of transactions.
- Proven history of proactively identifying and researching legal risks and issues and effectively counselling clients regarding same providing actionable risk mitigation strategies.
- Strong ability to work with and coordinate activities across a large number of individuals across various functional areas and effectively communicate the impact of law and regulation on business operations in a solutions-oriented manner.
- Experience working in a global company and matrixed environment desired.
- Fluency in the languages of the countries supported, would be an additional asset.
